Motorista nakabangga ng bike na nagkakahalaga ng 458K; Pamilya ng biktima, hindi magsasampa ng kaso

Nalula at natulala ang isang motorista ng malaman ang halaga ng bisikletang kanyang nabangga.

Ayon sa Facebook post ng netizen na si Rome Vlad Salentes Jacala, nagkakahalaga umano ang bisiktela na Colnago at may brand na Cicli Corsa na aabot sa 458K.

Makikita rin sa larawan na putol ang top tube ng bike na kung ipapaayos ay malaki rin ang magagastos.

Samantala, sa Facebook post ni Chad Rosales, ang anak ng 71-anyos na lalaki, ang kanyang ama ay isang “seasoned cyclist, a Tour of Luzon survivor, with decades of cycling experience."

Ang nakabangga naman sa kanyang ama ay isang criminology student and part-time janitor sa isang unibersidad.

Ayon kay Rosales, hindi na umano sila magsasampa ng kaso sa motorista dahil makukulong ito at alam nilang wala itong pang-piyansa. At kung makukulong ito ay hindi na siya makakapagtrabaho o makakapag-aral. Ayaw umano ng pamilya ni Rosales na mangyari ito.

“If he couldn't post bail, he would be detained indefinitely, dropped from his classes, and terminated from work for AWOL. This means that on top of his civil/criminal liabilities, he would lose his opportunity to get his life together, finish school, and be a responsible citizen. We couldn't allow it to happen,” sabi ni Rosales.

Dagdag pa ni Rosales, kahit na duda sila sa offer ng motorista na babayaran sila sa mga damages sa nangyaring insidente, tinanggap na lamang nila ito dahil ang mahalaga sa kanila ay ang mabilis na paggaling ng kanyang ama.

Narito ang buong post ni Rosales:

"A motorcycle rider crashed into my father who was cycling along 41 KM Marilaque Road, Brgy. Pinugay, Baras, Rizal on 29 February 2020 at around 8:30AM.

Rider, a criminology student and part-time janitor at a university, ran an errand for his employer morning of said day. Then, without his employer's consent, he rode to Marilaque driving a Yamaha SZ 150. It was his first time riding to Marilaque, and he did it alone.

My father is a seasoned cyclist, a Tour of Luzon survivor, with decades of cycling experience. Sadly, his years of experience could not protect him from an inexperienced and incompetent motorcycle rider.

I'm reminding everyone to be mindful of cyclists on the road - they have the right to use our roads too.

I'm also reminding our cyclists to exercise extra safety precautions and follow traffic rules at all times.

Let's keep our roads safer for everyone!

P.S. We decided not to file charges against the rider.

We would have wanted for charges to be filed against him first before we enter into an amicable settlement. But if we did file charges, he would have to be detained. And if he were detained, he would not be able to attend classes and report for work until he post bail.

Unfortunately, we were not sure if he or any of his friend or relative (in Samar) has the financial capacity to post bail. If he couldn't post bail, he would be detained indefinitely, dropped from his classes, and terminated from work for AWOL. This means that on top of his civil/criminal liabilities, he would lose his opportunity to get his life together, finish school, and be a responsible citizen. We couldn't allow it to happen.

So, we accepted his offer to voluntarily pay for the damages he caused in exchange of not filing criminal charges against him. I'm unsure if he has the means to pay (probably none), but it is the least of our concerns. Our father's speedy recovery remains the most important to us."
